Liability Waiver

I understand that in consideration of being allowed to participate in the activities in the programs of Ralph Gracie Idaho Falls facilities located at 2728 14th N, Suite G, Ammon, ID 83401 and equipment in addition to the payment of any fee or charge this waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) my use of all amenities and equipment in the facility and my participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment, (c) my instruction, training, and supervision, and (d) my slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas.                    
I am aware that because physical exercise can be strenuous and subject to risk of serious injury, Ralph Gracie Idaho Falls urges you to obtain a physical examination from a doctor before participating in any exercise activity or using any exercise equipment. I agree that if I engage in any physical exercise or activity, or use any club amenity on the premises or off premises including any sponsored club event, I do so entirely at my own risk. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely my responsibility and I should consult a physician prior to undergoing any dietary or food supplement changes. I agree that I am voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. Ralph Gracie Idaho Falls are also not responsible for any loss of your personal property.


I further agree to indemnify and hold harmless each of Ralph Gracie Idaho Falls, its members, managers, owners, future employees and agents harmless from and against all loss, claim, damage, liability, cost or expense arising from any action, claim or proceeding brought against any of them by any guest or family member using Ralph Gracie Idaho Falls' facilities, either with or without my consent, knowledge or supervision. Additionally, I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate marketing or promotion purpose by Ralph Gracie Idaho Falls.


I further acknowledge and agree that neither party shall be liable to the other party for any special, indirect, incidental or consequential damages arising out of this Agreement. Should I decide to participate in the membership option of private lessons ("Private[s]") I acknowledge and agree that Ralph Gracie Idaho Falls allows for a rescheduling of any Privates I may need to reschedule. However, any Private that I fail to give 24 hour notice on shall not be rescheduled or credited without approval from Ralph Gracie Idaho Falls. Except as otherwise specifically set forth herein, Ralph Gracie Idaho Falls' total liability to me under or in connection to this Agreement shall not exceed the amounts paid or payable to Ralph Gracie Idaho Falls hereunder; provided however, that the foregoing limitation of liability shall not apply to the willful misconduct of Ralph Gracie Idaho Falls. Any action against Ralph Gracie Idaho Falls arising out of, resulting from, or related to the performance or breach of this Agreement shall be filed not later than three (3) months after the cause of action has accrued. All disputes arising out of this agreement shall be submitted by the parties to this agreement to arbitration in Bonneville County, Idaho. Note: Should any part of this agreement be found by a court of law to be against public policy or in violation of any Idaho state statute or case precedence, then the remainder of this document will remain in full force. Agreement Term: I acknowledge that membership rates are subject to change, and are non refundable. Cancel or request pause at any time.
